Accused have examined DW1 Geeta who has deposed that on the day of incident, at about 2.30 / 3.00 pm, she saw a quarrel between Waseem and other persons in which accused sustained injuries by danda along with complainant, but accused did not quarrel with anyone. During cross examination by Ld. APP for State, it is admitted that quarrels are routine affairs in the area, but she did not see any quarrel between the accused and complainant. It is admitted that quarrel kept going on upto 5.00 pm and she was not aware as to who caused injuries to whom. 7. PW-2 HC Krishan Kumar deposed on oath that "That on 22.10.2018, I was posted as Ct. at PS Vasant Kunj South and on that I along-with Ct. Sandeep were on duty in the area of beat no. 8, K Block, Mahipalpur vide DD No. 33B dated 22.10.2018 which is now Ex. PW-2/A. At around 07:40p.m., when we both police Page no. 4 of 13 Cr. Case No. 4343/2019 STATE Vs. KAPIL 533/2018( Vasant Kunj (South)), u/s 33 of Delhi Excise Act officials were present Shukra Bazar, K Block, Mahipalpur, then we saw that one person was coming and carrying one plastic katta on his head. After seeing us, he tried to return back along-with the said katta. Thereafter on suspicion we both official chased behind the said person and apprehended near Payal Apartment, Tara Chand Colony, K Block, Mahipalpur. On checking of katta we found illicit liquor in the katta. Thereafter Ct. Sandeep informed the recovery of illicit liquor from the accused to duty officer of PS Vasant Kunj South. After some time HC Vishram Meena had come to the spot and we told him all the incident and handed over accused along- with recovered illicit liquor. Thereafter, IO made efforts to join the independent public witness but none was ready to join us and due to paucity of time, IO could not served the written notices to them. Thereafter, IO checked the bag/plastic sack and we found total 150 quarter bottles on which it was mentioned "Bouncer Orange for sale in Haryana only 180 ml Spiced country Spirit ENA based" and the all quarter bottles of illicit liquor were from same brand. Upon asking, accused revealed his name as Kapil. Thereafter IO took one quarter bottle for sample and the remaining quarter bottle was kept in the same katta and the same was sealed by the seal of "VR" and seal after use handed over to Ct. Sandeep. The IO had given serial no. S1 to the plastic sack in which the remaining i.e. 149 quarter bottle were kept and serial no. S2 to the sample.

6.   PW­1   Pooran   Mal   Saini   in   his   statement   has   stated   hat   on (SC No.57867/2016) (State Vs. Kapil Anand)   Page No.4 of pages 10 10.04.2014, he had unloaded his truck bearing registration no.RJ­14GC­ 7297 at Mangol Puri and he had received cash freight charges from the party. Thereafter, he had to load his truck for Jaipur with Plywood from Hirankudna Mod, Delhi and at about 01:00 PM when he had reached Hirankudna   Mod   to   load   the   plywood   and   parked   his   truck   near   the godown and was waiting for that person who had booked the plywood from the godown, in the meantime one person came there in a car and asked  him  as  to  why he   had  parked   his truck  there.  Thereafter, that person started grappling with him. That person did not take from him as in the meantime one police official reached there and took that person with   him.   That   person   was   not   carrying   any  arm  with   him.   Someone might have informed the police. Police reached there.  Police did not record his statement. Police had enquired from him and he had stated the same facts as deposed by him in the court.  His helper Subhash was also with him on the truck on that day, however, at the time of incident, he had gone to nearby Dhaba to take tea.  Police officials took him to P.S. Mundka and obtained him signatures on some blank papers. On seeing the accused, he categorically stated hat he is not that person who had grappled with him on that day and was taken by the police officials from the spot.

10 Furthermore, in the present case, material witnesses have not been examined despite ample opportunities having been granted to the Case No. 81/2/00 State Vs. Kapil Etc. 7/9 Prosecution and in such eventuality, it is not clear as to whether the proceedings, as alleged, have ever been conducted or not. In such circumstances, investigation carried out comes under a big question. 11 So far as the testimonies of other witnesses i.e., PW2 to PW6 are concerned, the same are formal in nature as their role came into picture after the incident. Furthermore, they have shown several other discrepancies and contradictions in the case of the prosecution and have raised further doubt regarding correctness of the same. Testimonies of different witnesses are not complete harmony with each other and there are several diversions amongst them. It is clear from the evidence of the different witnesses that a proper chain of incidents has not been maintained in a reliable manner qua material aspects of the case property and it creates doubts as to whether these witnesses were present on the spot or not.

In present case the seal was neither handed over to an independent witness nor deposited in malkhana. No explanation has come on record as to why handing over memo was not made or seal was not handed over to an independent witness or deposited in malkhana. In these circumstances, the possibility of tampering of case property cannot be ruled out.

"......On 06.03.2017 at about 6:30 a.m, when I was going to Nangli Dairy to bring water, Kapil obstructed my way in front of his house and stated that if I will not allow him to fill the water then he will not allow me to leave his street, to which I replied that the way is for everyone, I will go from here. As soon as I started leaving, Kapil Yadav started beating me with wood (fatta). I Judgment 2 of 11 FIR NO. 178/17 State Vs. Kapil & Ors made noise. Hearing my voice, my husband started coming towards me. At the same time, Reena, Asha and Dinesh also came there. Reena and Asha caught me. Dinesh and Kapil hit me on my hand and head. When my husband tried to save me, he was also beaten up, I became unconscious, my son dialed number 100. The police took us to Jafarpur hospital, from where we were taken to Din Dayal and then we were taken to Ram Manohar. Our neighbor Ravi also accompanied us for help. After taking treatment, I started living in my house. After one month, Jagannath, a relative of Dinesh and Kapil, came and asked me to compromise the matter, otherwise I would be killed. On 06.04.2017 at night, Kapil, Dinesh, Jagannath and his companion came there. Jagannath and his companion came there in the car of our neighbor. Both of them pressed the mouth of my son Praveen and took him as well as Ravi in their car. They gave beatings to my son and Ravi however, my son somehow managed to returned home and narrated the entire incident to me. I alongwith my neighbour went there but all of them ran away. We made a call at number 100 and the police took us to the police station and they gave their complaint. Thereafter, on 27.04.2017 Jagannath came, abused him and threatened Ravi...... "
