I find that a learned Single Judge of this Court in an unreported decision
dated 2nd May, 2012 in CRR No.874 of 2008 (Smt. Sadhana Das vs. State of
West Bengal & Ors.) had the occasion to deal with the selfsame notification and
had held that the said notification would be prospective in operation as the
notification is completely silent as to its retrospective operation either expressly
or impliedly.
