On a careful consideration of the pleadings on record, we noted that the issue raised in the present O.A., i.e., whether a pensioner is entitled for the pensionary benefits in accordance with the grade pay corresponding to the pre-revised pay scale from which he had retired or as per the upgraded pay scale to the post, has recently been dealt with by a coordinate Bench of this Tribunal in an identical matter, viz. O.A. No. No.2784/2021 titled as Suresh Pal and Others (supra). This Tribunal after detailed consideration of the issue and taking into consideration various decisions of the Apex Court, High Courts as well as this Tribunal and the policy governing 16 OA No. 2197/2016 Item No.54/C-5 the pensioners, dismissed the O.A. vide detailed Order dated 03.07.2023. 5. The respondents in the reply statement submit that the applicants in this OA were earlier before the Tribunal and the present OA is not maintainable being barred by res judicata. Applicants No. 1 & 3 4 O.A.060/00470/2017 Bhag Singh and Ajay Kumar had earlier filed OA No. 476/2015 titled Suresh Pal and Ors. Vs. UOI wherein they have challenged the selection of 157 MTS by ignoring the merits of the applicant who should have been selected based on their qualification and experience. The above OA was disposed of by passing the following order:-
