The Darcah Committee, Ajmer vs State Of Rajasthan on 24 April, 1961

Proceedings before a Magistrate for the recovery of expenses instituted by a Municipal Board were held in the Dargah Committee Ajmer v. State of Rajasthan, AIR 1962 SC 574 to be proceedings before a persona designata and not a Court because the proceedings were of a civil nature. The jurisdiction of a criminal court does not include decision of a dispute or a civil nature and, therefore, the jurisdiction conferred upon the Magistrate under the Municipalities Regulation could not be said to be a jurisdiction to be exercised by him as a criminal court. All these cases are distinguishable from the instant case.
