Nivedita Sharma vs Cellular Operators Ass. Of India on 5 May, 2014

In the case of Nivedita Sharma (supra), the case was considered under the Consumer Protection Act, 1986 and considering that there are provisions of appeal/revision under the said Act and that is why, the said case was decided stating that alternative remedy is available and in view of that, that petition was not fit to be entertained. It is well settled that once the party has chosen a forum, he is required to go on that. In that case, the aggrieved person has chosen forum of District Consumer Redressal Forum and that is why, in that background, that order was passed and the same is not in dispute.
