In Bharat Aluminium Company Vs. Kaiser Aluminium Technical
Services Inc. reported at 2012 (9) SCC 552 in Paragraph 176 it was held that
as a matter of law, an inter-parte suit simply for interim relief pending
arbitrations, even if it be limited for the purpose of restraining dissipation of
assets would not be maintainable. It was further held that pendency of the
arbitration proceedings outside India would not provide a cause of action for a
suit where the main prayer is for injunction.
