On the aspect of apportioning the
liability is concerned, the Court had taken into consideration
the principles laid down by the Hon'ble Supreme Court in the
case of Khenyei Vs. New India Assurance Company Ltd.,
and others, reported in 2015 (9) SCC 273. Thus, holding
the claimant entitled to recover the amount of compensation
from either of joint tortfeasors.
