36. Reverting back to the impugned regulations, we
have already noticed that the common thread running
through the above regulations is the need to obtain NOC
from the State Government in the event of increase in
seat intake or starting of a new course which is
mandatory. We have also noted above, challenge to
Regulation 3.4 has been repelled by this Court in
