40. Hon'ble Supreme Court in case "Kusum Sharma & Ors. Vs
Batra Hospital & Medical Research Centre & Ors.", 2010(2) RCR(Civil)-
161(SC), held that the doctor was not guilty of negligence when the hospital
and doctors attended the deceased with utmost care, caution and skill and
the doctor who performed the operation had reasonable decree of skill and
knowledge and adopted the procedure which in his opinion was in the best
interest of the patient.
