13. Now, every Act affecting vested rights is prospective and not retrospective. It is, however, open to the Legislature to make it retrospective and this it can do by a clear intention or by necessary implication. Here the unsuccessful party would have, but for the 1949 Act. right of appeal to the High Court and the question is whether the amending Act has taken away the right. Now, it is well settled that to disturb an existing right of appeal is not a mere alteration of procedure: see Nana Aba v. Shehs Andu, 10 Born. L. B. 330 : (32 Bom. 337).
