13. Since in the case at hand, 41 posts were available in
general category, 168 candidates were initially declared successful
for verification of documents, but ultimately only 132 candidates
were called for personality test. Though, Mr. Kush Sharma, learned
counsel for the petitioners vehemently argued that aforesaid clause
pressed into service by the Commission is not applicable in the
present case, especially when same was not incorporated in the
advertisement, but having carefully perused language employed in
the advertisement, this Court finds that though there is no specific
mention of aforesaid clause in the advertisement, but language is
almost same and as such, mere non-incorporation of aforesaid
