2. At paragraphs namely 30, 33.1, and 38 of Mathew Varghese v. M. Amritha
Kumar, (2014) 5 SCC 610. The Supreme Court was considering Section 13(8)
of the SARFASEI Act 2002. Rule 8(8) was only referred and was not germane
to the issues in the said case. Rule 8(8) above was not substantively
considered or dealt with by the Supreme Court. It was in fact rule no. 8(6) and
9(1) which were germane to the Case.
