39. The judgment by Bombay High Court in Bank of India (supra) has
taken a note of the said fact and, after considering D & H India Ltd. (supra),
held that an appeal under Section 13 of the Commercial Courts Act, 2015
will be maintainable only against the orders which are enumerated or
enlisted in Order XLIII of the CPC.
