In the case of N.P. Ponnuswami v. The
Returning Officer, Namakkal Constituency, Namakkal,
Salem Dist., and Others [ AIR 1952 SC 64], the
Constitutional Bench of the Apex Court dealt with the scope
and ambit of the bar contained in Article 329 (b) of the
Constitution of India. While interpreting the words "election" as
used in Part XV of the Constitution of India, the Hon'ble
Supreme Court has opined that, "the word "election" has been
used in the wide sense, that is to say, to connote the entire
procedure to be gone through to return a candidate to the
legislature. Therefore, the word "election" used in Article 329 (b)
may be taken to embrace the whole procedure which consists of
several stages and embraces many steps, whereby an "elected
member" is returned." Hence, the word "election" has not been
used in a narrow sense.
