15. The learned counsel for the petitioner refers to a recommendation made by the Indian Council of Forestry Research and Education, Dehradun in Kalpavriksh vs. Union of India (supra). The said recommendation was made in July 1999 because on account of continued digging of the earth near the roots of trees on Tilak Marg and Akbar Road, the tamarind trees (Tamarindus indica) were drying up and dying. Sadly, almost of a quarter of century later, the lack of care continues unabated. It would, therefore, be in the fitness of things, if permission of the Tree Officer is first taken before the initiation of any civil work, which are likely to be made within a distance of 2mts from any existing tree. An order, in this regard, may well be passed by the Chief Secretary, GNCTD, with a copy to all Central Government agencies, Commissioners of the Municipal Corporations and CEO, Delhi Cantonment Board. Insofar as the status quo was not maintained at the site and no reply been filed by Respondent Nos. 2 and 3, in terms of the detailed aforesaid notice, the said respondents are held guilty having committed contempt of court and for wilfully disobeying the directions of this court. They are held guilty of contempt of court for wilfully disobeying the directions of this court and of the NGT, in particular the R-2 and R-3 have breached this court's directions as specified in the order dated 25.02.2022 in paragraph 6 thereof. The said paragraph quotes an order in another case i.e. Cont. Cas (C) No.851/2021 on 03.12.2021 which directed PWD to exercise due caution apropos all its ongoing civil works as well as for all future projects. The respondents have also failed to comply with this court's directions dated 10.02.2010 in S.C. Jain v. UOI & Anr., W.P.(C) 11162/2009, inter alia, as under:
