the BDA. The plaint is silent in respect of the survey

same is not helpful for the plaintiff.

29. I have carefully gone through the dictum laid
down in the above cases. In the case on hand the
plaintiff has asserted that he is in lawful possession of
suit schedule property having acquired the same by
virtue of registered sale deed executed by Syeeda.
Whereas as discussed above the plaintiff failed to
prove the very identity of the suit schedule property
and so also his lawful possession within the possession
over the said property. Hence with due respect to the

principles laid down in the above decisions the same
are not helpful for plaintiff.
