71. We may now consider some of the contentions advanced on behalf of the appellants. It was pointed that the Calcutta Bench in the case M. N. Dastur & Co. Ltd. (supra) has relied upon the decision of the Calcutta High Court in the case of Darbhanga Marketing Co. Ltd. (supra) and the decision of the Bombay High Court in the case of New Great Insurance Co. Ltd. (supra).
