20. The Respondents by purporting to enhance entry tax on limestone if
stock transferred outside the State after clinkerisation were essentially
seeking to compensate themselves for loss of revenue from sale of cement
which would have accrued by sales tax if the cement had been manufactured
and sold in the State. The unsustainability of the contention on behalf of the
State is evident from the observations in Hotel Balaji (supra) relied upon by
the Petitioners observing as follows:-
