11.3.1 In the aforesaid set of facts, the election once
having been declared, the same was postponed and in view
thereof, the analogy drawn in A.A. Kureshi (Supra) was
followed. The said decision was taken in the facts of the said
case.

11.2 Further, reliance as placed upon the ratio as laid down in
case of Pradeepbhai Parshottambhai Sojitra vs. State of
Gujarat, reported in 2009 (2) GLH (UJ) 2, in the opinion of this
Court, is not applicable in the facts of the present case in light
of the fact that in the said proceedings, the State itself
declared that the State would have no objection to the
committee constituted by the Court until the newly elected
body took over the charge of office.
