In Union of India and Anr. v. Cynamide India Limited and Anr., AIR 1987 SC 1802, the Supreme Court considered the grounds for challenge of a subordinate legislation. The notification issued by the Central Government fixing the minimum price under the Drugs (Control) Order, 1977, was challenged in the High Court. The High Court had allowed the writ petition against which the Union of India filed an appeal. In paragraph 4 of the said decision the Supreme Court observed as follows :
