10. The Commission notes that the reply provided by the CPIO by clarifying
the factual position as explained in para 9 above is well within the provisions of
the RTI Act, 2005, as the CPIO can only provide such information as is held in
the office record, and as a matter of fact, he is not obligated to create

information under the mandate of RTI Act. The Commission placed reliance on
a judgement passed by the Hon'ble High Court of Delhi dated 04.12.2014 in the
case of The Registrar, Supreme Court of India vs. Commodore Lokesh K. Batra
