4. Having heard learned counsel for the appellant
and the respondent and considering the ripe age of the
appellant, being 75 years, we consider it appropriate
to extend to him the same benefit as in the decision
of this Court in Ahamed Masood Vs. State, represented
by Inspector of Police, Criminal Appeal No. 3410 of
2025, in which case, under similar circumstances this
