Learned counsel for the opposite party No. 1 places reliance on a
judgement reported at (2001) 8 Supreme Court Cases 187 (Biswanath Poddar
versus Archana Poddar and Another). On the basis of such citation, it is argued
that the Supreme Court held the provisions of Section 14 of the West Bengal
Premises Tenancy Act, 1956, which was the predecessor of the present Act of
1997, to be mandatory. Section 14 of the 1956 Act stipulates that after the
commencement of the Act no tenant shall, without previous consent in writing of
the landlord, sublet the whole or any part of the premises held by him as a
tenant.
