Accordingly, the present criminal misc. application succeeds and is allowed. The impugned summoning order dated 4.5.2022 passed by Judicial Magistrate, Sant Kabir Nagar in Complaint Case No. 717 of 2017 (Amresh Kumar Gupta Vs. Ishwar Chandra Gupta and Others), under sections 323, 504, 506, 377 IPC P.S. Kotwali, Khalilabad, District Sant Kabir Nagar, is set aside. The Judicial Magistrate, Sant Kabir Nagar shall pass a fresh order in the light of the observations made herein above.
