I fully agree with the views taken by the
learned Single Judge of this Court in Ram Udar Rai
(supra) and hold that if a claim under Section 22(1)
of Act is to be staked against a proposed transfer of
interest then the proper forum would be a Miscellaneous
Judicial Case, however, if such a claim of preferential
right is being staked after completion of transfer then
the remedy would be filing of a regular civil suit.
