Vaidialingam, J., of the Kerala High Court in Chacko case 1962-I L.L.J. 341 (vide supra) merely followed the judgment of Ramachandra Ayyar, J., in Murugan Transports case 1961-I L.L.J. 283 (vide supra) in preference to that of Balakrishna Ayyar, J., in Wakefleld Estate case 1959-I L.L.J. 397 (vide supra). For exercising that preference the learned Judge also relied on some unreported judgment of Varadaraja Ayyangar, J., of that Court (Kerala High Court).

In Murugan Transports, Cuddalore v. Rathakrishnan (P.) and Ors. 1961- I L.L.J, 283, Ramachandra Ayyar, J., seems to have taken a different view. The learned Judge with regret was unable to agree with the view taken by Balakrishna Ayyar, J., in the case of Wakefleld Estate 1959-I L.L.J. 397 (vide supra).
