In this regard, the
Commissioner has exercised its power under Section 280D
of the Act, which enables him to take action even without
issuance of notice in this regard as is referred by the
Supreme Court in the case of Volga Tellis And Ors. Vs.
Bombay Municipal Corporation And Ors. reported in AIR
1986 SC 180 wherein it has been held that 'a discretion has
to be exercised in a reasonable manner so as to comply with

the constitutional mandate that the procedure accompanying
the performance of a public act must be fair and reasonable.
We must lean in favour of this interpretation because it helps
sustain the validity of the law.'
