8. Learned counsel appearing for the Petitioner, on the
other hand, heavily relied upon the judgment in Nihar Ranjan

Choudhury's case (supra). She further contended that the
judgment that has been referred to by the learned Additional
Government Advocate in W.A. No.805 of 2021 and batch of
Writ Appeals has been specifically taken note of by the learned
coordinate Bench in its judgment dated 06.11.2023. Learned
coordinate Bench referring to the judgment of the Hon'ble
Supreme Court in Union of India and others Vrs. K.V.
Jankiraman and others, reported in (1991) 4 SCC 109 and
similar other judgments of the Hon'ble Supreme Court
including the case of State of Punjab and others Vrs. Chaman
Lal Goyal, reported in (1995) 2 SCC 570 was pleased to grant
ad-hoc promotion to the Petitioner in that case.
