3. The applicant has argued the above matter and
stated that he has a heat condition and any
dislocation would affect his health. He has
emphasized his seniority amongst the three persons
available in Nagpur, the long duration of service at
Nagpur of Shri Jadhav and the availability of vacancy
at Doordarshan Kendra, Nagpur. He has also referred
to the order of the Allahabad Bench of this Tribunal

India dated 28.04.2015 where it was held that not
giving the same treatment in similarly placed cases is
discrimination.
