4. It is no doubt true that the larger bench of the Apex
Court in R.L.Jain's case while holding that taking of
possession of immovable properties much before the issue
of preliminary notification under sub Section 1 of Section
4 of the land Acquisition Act is illegal nevertheless
directed that no interest would be paid on additional
market value under Section 23 (1A) of the Land
Acquisition Act for the period from the date of possession
if anterior to the date of issue of preliminary notification
under Section 4 (1) and in addition observed that the
landlosers are entitled to rent or damages in respect of the

acquired land for the period anterior to the preliminary
notification from the date of possession.
