9. That apart, this court in the case of Suseela and 4 others Vs. A.S.L.Rajan [1999-2-LW-772] referring to the classification of suit property in revenue records as Agricultural land, held that so long as there is no modification or variation in the classification of the suit lands from nanja into 'house sites' and in the absence of any material produced by the Defendants for establishing the same, the court fee has to be paid only as kist paying lands. In the case of Kamaleshwar Kishore Singh Vs. Paras Nath Singh and others [2001-4-CTC-764], it is held that the court fee has to be paid on plaint as framed and not as it ought to have been framed, unless while drafting the plaint the Plaintiff had attempted at evading payment of court fee by his astuteness in drafting. It is held that it is substance of relief and not form which will be determinative of valuation and payment of court fee.
