17. The first factor provided in Section 23(1) of the Act specifically provides that for determining the amount of compensation to be awarded for land acquired under the Act, the Court shall take into consideration the market value of the land at the date of publication of the Notification in the Gazette under Section 4(1) of the Act. Thus, the market value of land acquired under the Act has to be determined by the Court as of the publication date of the Notification in the Gazette under Section 4(1) of the Act.
