said case, the petitioner had claimed
172 days of compensatory leave for work done on days of rest
in terms of the provisions of Section ... approached the Court either
when he was denied the un- allowed compensatory leave or
within three years even from the date of his superannuation
directed to
release the payment of 619 days of accumulated
compensatory leave along with interest @ 12%
p.a. w.e.f. 2011 in favour ... compensatory leaves:-
"Vide judgment dated 16.06.2021,
respondents were directed to release the payment of
619 days of accumulated compensatory leave to the
petitioner within
which provides the accumulation, carry forwarding
and encashment of the Compensatory leave of any
employee in a calendar year. However, due to acute
shortage ... meeting decided to carry forward the
unutilized Compensatory leave.
It is pertinent to mention here that, in this regard vide
earlier instruction issued
held
that there was no provision for encashment of the
compensatory leave and the same could have only
been availed by the employee while ... held that there is no provision for accumulation and
encashment of compensatory leave.
2. On the other hand, learned counsel for the
petitioner would invite
appellant
issued an Office Order cancelling the option of compensatory leave
against the extra attendance and provided for extra emoluments for
extra attendance. The respondent ... another employee, the appropriate
Government referred the dispute regarding cancellation of compensatory
leave for adjudication to the Industrial Tribunal.

(e) The Writ Petition filed
extra wages in lieu of un-allowed 149 days
compensatory leave (sunday rests) for work done
on days of rest in terms of Section ... which the petitioner
was drawing at the time of accrual of compensatory leave.
Opposing the above plea, learned counsel for the
respondent-Corporation while canvassing
right. It was further stated that plaintiff applied for grant of
compensatory leave but as the plaintiff ... having any compensatory
leave in his account, the same was declined and the leave was again
treated as extraordinary leave without pay from 26.2.2002 till
days in June, 1991, though the
delinquent had applied for compensatory leave through proper
channel and then used abusive language and threatened
