following questions have been raised:
(a) If any building collapses, after 19 years of its construction
and that too after withstanding worst earthquake ... were
collapsed due to improper structural design or improper construction
of the structure of the collapsed building or due to mistake of the
respondents-accused
have constructed the
building that has collapsed. That the construction of the collapsed
building was completed in May 2000, and defendants ... another old
building constructed by the appellants has not collapsed. Hence,the
present incident of collapse
of a newly-constructed building cannot be treated
that they are not liable for any negligence
in the collapse of the collapsed buildings, they preferred

of the collapsed buildings were of very poor quality as per the

of all these reasons the entire building, which was under
construction, collapsed on 28th January 2011 at about 7.45
AM in the morning ... quality have not been used,

on the fateful day in the morning hours taking lives
supplied to the defendants were of inferior quality
because of which, construction collapsed.
18. On the contrary, on perusal of the Inquiry
Report ... carrying out the
tender work within time and as the construction
collapsed as recorded hereinabove, the plaintiff-
G.I.D.C had to re-tender

he has taken any part in the construction activity of the collapsed
building. Apart from that, a compromise was arrived at between ... rashness on the part of the respondents in the

that there is no prima facie
responsible person for the collapse of the building as the super-structure had collapsed because of irresponsible pattern of construction and certain omissions and commissions ... Valhalla Patel had complained about the poor quality of construction much prior to its collapse and also regarding irregularities in constructing the building.
4. According
supervised the construction materials used for the said construction activities and only after its approval at each stage, the construction was carried out, therefore, there ... respondent No. 1 for which no dispute arises except collapse of ESR at Shivkrupanagar for construction for capacity of 10 lac liters of water

that the petitioner was knowing the above illegal construction which was the main reason of the collapse of the building.
