amount of home loan with DCHFC. However the petitioners ganged up
together to create circumstances so that ... complainant met the Administrator, he
informed that there are certain dues of DCHFC towards home loan which
had to be cleared and till then
which he can obtain from RCS. There were litigations between society and DCHFC. Counsel
of DCHFC Limited stated that the defaulter societies did not file ... their audit reports with
DCHFC, they might have filed the same before RCS. He also stated that they are not holding
the audit report
dues of the said society and loan liability
of DCHFC Ltd. still exists. It is the liability of the respondent to deal with
any dispute ... raised by the DCHFC Ltd. However, the respondent
approached to settle the dispute through Sh. L.R. Madan, President to the
effect that the petitioner

entire property of the Society was mortgaged to DCHFC which had given a
loan for construction of the housing project. No Objection ... Certificate from
the DCHFC was never secured. The rules were further blatantly violated and
a mandatory declaration--to the effect that neither
loan along with interest payable
to Delhi Cooperative Housing Finance Corporation Limited („DCHFC‟)
which by an order dated 8th January, 2001, was referred
from 1994
till 2003. The loan which the society has taken from DCHFC
was given to all members as per the Resolution of the society ... outstanding amount
which is paid by the Respondent No.1 to the DCHFC and the
respondent society, under protest to avoid constantly increasing
penal interest
