Writ Petition No.2192 of 2005 the accused filed application seeking de-exhibiting of the documents filed by PW 1 with his evidence on affidavit
challenge the admissibility of the said document. Accordingly, he sought
to de-exhibit the said document.
A counter was filed stating that the said application ... Whether the document marked as Ex.A1 can be de-
exhibited, if so to what result?
The trial Court, by its order dated
Evidence Act to de-exhibit the document once exhibited in evidence, cannot be found fault with. However, such exhibition of documents shall be in accordance ... exhibited as Exhibits 3 to 9, that itself did not constitute exhibition of those documents in evidence. Besides, the endorsement itself disclosed that the exhibition
deferred at request. Later, the plaintiff filed the instant application for
de-exhibiting the said document marked as exhibit B1. The said petition was
resisted ... exclude the CC of unregistered partition deed from
evidence after de-exhibiting it, as it is not properly stamped and registered.

de-exhibiting the document Ex.P1, i.e. the Will dated ... read with Section 151 of the CPC for de-exhibiting the document Ex.P1
alleging that since in its order dated 18.03.2008, the Court
under Order
13 Rule 3 C.P.C . for de-exhibiting the agreement of sale
dt.23-06-2004.

document requires to be de-exhibited since it is a manipulated and a
created document.

therefore, it cannot be exhibited. If Court has wrongly exhibited it,
Court has ample power to de-exhibit the same.
