of mandamus directing the respondents to consider his name for DESM
BCB category to the post of Steno Typist.
2.) Respondents have advertised posts ... Steno Typists on
15.9.2010 while reserving 8 posts for the DESM BCB category. The
petitioner had applied for the aforesaid post while enclosing certificate
relates to reservation in
so far as Ex-Servicemen, ESM and DESM is concerned which reads as
under:-
"DESM candidates who fulfill all conditions ... further to be noted that the petitioner is candidate under DESM woman. If
the ESM woman are not available in that event the selecting authority
interview for the post of
Dispenser Ayurveda under the DESM category.
The posts were originally advertised in the year 2013 when the
petitioner had applied ... hard copy of the
application form he had in fact annexed a DESM certificate of the year 2013
which, as per the instructions relating thereto
that there was no column mentioned for dependents of Ex-
serviceman (DESM). The petitioner did not know that there was any
category of dependent ... position that some other candidates similarly
also had not applied in the DESM category but as per the State they had
annexed their certificates
along
with a list of errors to the Professor and Head, DESM, NCERT, Sri
Aurobindo Marg, New Delhi for rectification of the pending 11 errors ... another representation dated 4.11.2017 (Annexure P-6) to
the Professor and Head, DESM, NCERT, Sri Aurobindo Marg, New Delhi
for rectification of the errors
petitioner has got 82 marks against the
category of Dependent Ex-servicemen (DESM) for BC-B category. The cut
off is 66 marks ... post is stated to have been consumed by ex-
serviceman and, therefore, DESM candidates could not be considered
against the said category. It has been
that the opinion was
sought from the Professor and Head of Department,
DESM (Department of Education in Science and
Mathematics) whether M.Sc. (Biotechnology
accommodated,
the State should be directed to first try and accommodate these DESM
candidates against existing vacancies instead of resorting to the expedient
of terminating
candidates belonging to reserved categories of sports, ESM and DESM are
taken out, only 313 candidates i.e. 38.64% were from the non-reserved
categories ... shown as under:-
