1. The petitioner, who actually belongs to DESM category, says
that he inadvertently applied for the post of Conductor pursuant ... Advertisement No.3/2009 [Category 1] under ESM category instead of
DESM category. As per selection criteria dated 21.01.2011 (Annex P-5), the
candidate belonging
moved a representation dated 01.10.2018
(Annexure P-3) to consider him under DESM category, as he has
inadvertently applied under general category instead of DESM ... category. The
petitioner has been issued DESM certificate on 13.04.2018 by Zila Sainik
Board, Panipat (Annexure P-2).
Without commenting on the merits

under the ESM/DESM category was called for interview in the same
category but has been

adjusted in the wait list of DESM, the State has not been able to justify as to
how he made ... were thus to
be issued. The other candidates higher in merit in DESM category who have
not been admittedly called by the State before adjusting
order, dated 07.03.2018
(Annexure P-10), vide which his candidature, being a DESM candidate, has
since been rejected; "ii) That the petitioner ... submitted any valid
DESM certificate issued by the competent authority i.e. Zila Sainik Board
as mentioned in para 9 of the Information for Candidates
DESM=02 and PHC=01)
advertised on 08.10.2013 (Annexure P-2). In the selections, finalized in the
year 2014, the petitioner was placed at merit
namely,
Hemlata and Sunita Devi respectively have applied under the DESM
(General) category, while petitioner in CWP No.24279 of 2017, namely,
Rahul Yadav applied ... under the DESM (BC-B) category.
Learned Law Officer points out that there are sufficient number
of Ex-servicemen available for filling the advertised vacancies
response to the advertisement
dated 19.6.2015 (Annexure P-1), in the DESM (General) Category. In terms
of the advertisement, she was required to append
