seized pursuant to their disclosure statements. The appellants
underwent identification parade. Their fingerprints were examined, the seized
articles were sent for chemical and DNA test ... that evidence of experts who lifted the
fingerprints of the accused (from the house) along with the testimonies
Delhi where he was medico legally examined by a doctor. The
specimen fingerprints and signature of the accused were obtained. The
knife and the specimen ... fingerprints were then sent to Central Forensic
Science Laboratory (CFSL) for comparison. The fingerprints of the
accused had tallied with the fingerprints appearing

It is relevant to note that in the charge-sheet ... proved those documents and stated:-
“Darogaji had collected the fingerprint on shelf, box,
attachee, utensils and glasses of the kitchen form the
spot
contained one currency note of
Rs. 100/- which was suspected to have fingerprints. Ajit
Singh was tried and was convicted by the Additional Sessions
Judge ... There is no gainsaying the fact that a majority of
fingerprints found at crime scenes or crime articles are
partially smudged

and certificate of expertise of fingerprint specialist as Ex.P/46 has
been corroborated with call details
advantage of the fact that the
pistol recovered did not have any fingerprints on it. It
cannot lead to the conclusion that the appellants ... deliberately removed the fingerprints. Learned senior
counsel also submitted that merely because more than
one shot was fired would not lead to the conclusion that
grounds that the court has taken contrary view regarding the fingerprints lifted from the spot which according to the prosecution were of appellant Sudershan Dutta ... Devender Singh and convicting Sudershan Dutta on the basis of the said fingerprints.
