"Reverting then ... Much emphasis has been laid on certain observations of Gajendragadkar, J. who delivered what may be described as the majority judgment in that case
respondent has invited our attention to a decision of Mr. Justice Gajendragadkar in Civil Revn. Applns. Nos. 833 and 1253 of 1953 and Civil Rcvn ... which were decided on 11-8-1954 (Bom) (A). Mr. Justice Gajendragadkar examined the provisions of the Bombay Rents, Hotel and Lodging House Rates Control
appeal, and the appeal was decided by a Division Bench consisting of Gajendragadkar J., (as he that was), and Vyas J. The judgment recorded ... decision is reversed by the Supreme Court. In reaching the aforesaid decision Gajendragadkar J. As he then was, has also placed reliance upon the legislative
respondents to contend that Section 92 is not retrospective, and Mr. Gajendragadkar on behalf of the respondents has not raised any contention on this point ... first paragraph or the third paragraph of Section 92 .
