12. Based on the opinion of the Law Department, the Screening
acquittal, it was held, has to be honourable. As such, the expressions

21. Therefore, the principle of honourable acquittal depends on
facts and circumstances of each
service, the acquittal, it was
held, has to be honourable. The expressions
"honourable acquittal", "acquitted of blame",
"fully exonerated ... circumstances of the case.
13. Whether the acquittal of claimant was merely acquittal
or honourble acquittal, can be seen from the judgment
submitted that even in cases of acquittal,
departmental proceedings may follow when the acquittal is otherwise than
honourable. If the acquittal in a criminal case ... person is acquitted when the
acquittal is other than honourable.
21. The expression ‘honourable acquittal’ was considered by this Court in
S. Samuthiram. In that
service, the acquittal, it was held, has to be
honourable. The expressions ‘honourable acquittal’, ‘acquitted of blame’,
‘fully exonerated’ are unknown to the Code ... held even
in the case of acquittal, departmental proceedings may follow where the
acquittal is other than honourable. In State of Assam and another
person is acquitted when the
acquittal is other than honourable.
25. The expression “honourable acquittal” was
considered by this Court in S. Samuthiram ... giving him benefit of doubt and, therefore, it was not
an honourable acquittal, this Court held that the High
Court was not justified in setting
