applicants have not played any passive role in
the instigating the deceased to commit the suicide. In absence of any prima
facie case against ... commit suicide and as a result of such
instigation the other person commits suicide, the person causing the
instigation is liable to be punished under
Pradhan
vs State of Uttaranchal and Ors.8 (―Praveen Pradhan‖), instigation to
commit suicide has to be gathered from the circumstances of a particular
case ... direct evidence in regard to
instigation which may have direct nexus to suicide, an inference has to be
drawn from the circumstances to determine whether
suicide' which reads as under:-
"306. Abetment of suicide - If any person
commits suicide, whoever abets the commission
of such suicide, shall ... life by committing
suicide. If it appears to the Court that a victim
committing suicide was hypersensitive to
ordinary petulance, discord and difference in

Their Lordships in the aforesaid case of Chitresh Kumar

deceased for committing suicide. For abetment to commit suicide there
