daughter according to his means and capacity. After one year, his daughter ... complainant and her parents. He had not taken any of Istridhan items of
complainant in his possession. He was told by complainant that Istridhan items
Muslim Rites and
Ceremonies and her parents gifted her dowry/istridhan articles
including utensils made of silver and copper, jewelery articles i.e a
gold ... directed for registration of FIR.
PW1 further deposed that after FIR, some istridhan articles were
seized from his home vide
with wearing suits or dresses refusing to return back the dowry and
istridhan articles. She further affirmed that she gave a phone call ... before CAW Cell,
Sriniwaspuri on 23.06.2008 pointing out that the list of Istridhan articles was given on
25.07.2008. He also pointed out that
lacs in her marriage and had given all the
istridhan articles like motorcycle, fridge, T.V., washing machine
etc. and jewelery articles.
4. Pw1 alleged ... which was exhibited as Ex. PW1/B. PW1 exhibited list
of istridhan articles as Ex. PW1/C(running into three pages). She
stated
matrimonial home in three clothes on 12.09.2000 and had
misappropriated her istridhan. The parents of the complainant tried
their level best to settle the matter ... vain. The accused
persons have refused to return back her dowry and istridhan
articles and had misappropriated the same. Hence, the present
complaint
matter but in vain and when
complainant asked for return of her istridhan articles, the accused
became annoyed and they categorically refused to return ... accused persons from
the matrimonial home and they had retained all her istridhan articles
in their possession. She deposed further that nothing had been
recovered
framed against accused Chando Devi for
being entrusted with istridhan belonging to the complainant and for
dishonestly misappropriating the same. Both the accused persons
pleaded ... came back she did not take back her
jewellery and other istridhan articles with her and same remained
in possession of accused Chando Devi
further stated in
the complaint that complainant has left her istridhan articles at her
matrimonial home bearing no. 42, Overseas Apartment, Sector 9,
Rohini, Delhi ... Accused further stated that he never misappropriated any dowry
articles or istridhan of complainant and presently complainant is
residing in the flat of the accused
