Mubara'at means mutual release. A Mubara'at
divorce like Khula, is a dissolution of marriage by
agreement, but there is a difference ... wife, and
she desires a separation, the transaction is called Khula.
When the aversion is mutual,, and both the sides desire a
separation, the transaction
arrived at settlement by
execution of deed of dissolution of marriage by khula.
4. Learned counsel for the petitioners submits that
respondent No.2 - complainant ... marriage
has remarried and staying elsewhere.
5. The declaration of khula by mutual consent recognises
the acceptance of the parties for closure of the criminal
settlement by execution of deed of
dissolution of marriage by declaration of khula and
declaration of acceptance of khula, which also recognizes
closure ... parties are settled
and the same is narrated in the said khula nama. The
parties have also filed a joint memo and joint affidavit
before
wife herself divorced the
petitioner/husband by declaring 'Khula' and again on this score
O.P.No.2/wife ... witnesses including O.P. No.2/wife, the event of 'Khula' has
been brought in picture nor so suggested but subsequently, while
Mubara' at means mutual release. A

a marital status of a person in the matters of Talaq, Khula, Mubarat and
Talaq-e-Tafwiz. It was held that the Family Courts ... such parties and in the matter of unilateral dissolution of
marriage invoking Khula and Talaq, the scope of inquiry before the Family
Courts is limited

2. We submit that on 13.08.2011 at 17.00 Hours ... Respondent No.2 was dissolved by way of
`Khula' as per the Mohamedan Law. The
Deed of Dissolution of Marriage by Khula was
executed
Muslim woman's right to
seek divorce by way of 'khula'.
Upon being queried, counsel submits that 'khula ... talaqnama evidences divorce by the Muslim woman by way of 'khula'; and
to cite judicial precedents or authoritative text on Muslim
this "Khulanama".
11. The first party is seeking "Khula" from the
second party and the second party is accepting ... Khula" of the first party in presence of the
witnesses.
