additional carpet area of 197.83 sq.ft. She had purchased 56
sq.ft. carpet area. Thus, she was entitled to get total carpet area ... opponent no.2 for giving less area of flat and to
pay the price of less area given to her. Opponent no.2 replied
compensation of less carpet area to the complainant is concerned, we find that independent consultant was appointed to measure the carpet area ... carpet area. It is thus clear that the appellants have been deficient in making the flats as per the agreed area and the less area
Complainant is entitled for said amount.
4. As per Complainant, less carpet area than
agreed was given to new flat purchasers.
A report was filed ... record showing cost of `33,65,723/- in respect of less carpet area.
5. Complainant filed a complaint with prayer
that the Opponent be declared
respect of giving less area of flat to her. However, as opponents had not given
compensation in respect of less area of flat to complainant ... society
to accept carpet area of 709.36 sq.ft. from the opponents. Opponents submitted
that accordingly flat of that much carpet area has already been
