submitted that the respondent could
not have issued Look Out Circular (LOC) in the absence of
any material with respondent no.1 to conclude that ... intervene?"
Those questions were answered as follows:
"A. Recourse to LOC can be taken by investigating agency
in cognizable offences under
Prakashchand Doshi was co-operating with the
investigation and despite this the LOC has been issued against him. We
relied upon the decision ... dated
11th August, 2010 and allowed the petition and, consequently, the LOC
against Santoshkumar Prakashchand Doshi was quashed and set aside.
5 The case
been arrested and as such there is no need to keep the
LOC open. Accordingly, a request was made that the LOC
No.2019418781 opened ... above facts, Mr. Shinde, learned APP, makes
a statement that LOC against the petitioner is no more in force. The
prayers (a) and (b) sought
criminal
case is pending. The petitioner learned that Look Out Circular
(LOC) is issued against her and therefore, by way of present
petition ... claimed directions to the respondent to
withdraw the LOC against her, or in the alternative, seek a writ
to quash the same.
6 Ms.Ameeta
directed the CBI to file reply. We observed that Look Out Circular (LOC)
was issued against one Santoshkumar Prakashchand Doshi, who is
named ... However, no charge-sheet is filed against him and still
LOC was issued against him. We also observed that writ petition No.3272
challenge in this petition is to a Look Out
Circular ("LOC").
2. The petitioner says that, there are definite
guidelines enabling issuance ... have been made by respondent No.2-Bank to issue such
an LOC, yet the 3rd respondent has obliged the 2nd
respondent-Bank.
