Janekunte village, noticed that accused were
engaged in illegal mining of gravel/murram. On
seeing them, the drivers of Hitachi and Tipper ... involvement of
these petitioners in extracting the mining of
gravel/murram. The said gravel/murram is alleged
to have been extracted from the land belonging

Cr.P.C., alleging that the petitioners have extracted Murram
and transported the same have committed offence

2. Learned counsel appearing for the petitioner
submits that the "Murram" does not come under the
definition of minor and minerals
plaintiffs that the distance between the place from where the murram or mud was to be brought, i.e., from the earth work quarry ... based on the premise that the mud and murram was available at the nearby quarry which could be transported to the work-spot

Quarry in respect of remaining 5.00 acres of
land situate
draining works involve cutting of
bituminous road, WBM roads, concrete roads and
murram/gravel roads etc., The roads damaged are
proposed for restoration of their
defence of the accused that it is a village road
consisting of Murram ditches and dispersions he
should not have allowed the passengers/labourers
they came to know through one
reporter that this petitioner is extracting murram/gravel from his
agricultural land in Sy.No.175/A3. Accordingly
