accused, who was convicted in this case, was extended the benefit
of probation considering his age to be 85 years, whereas the trial
Court ... though has considered the prayer of the petitioners
for release on probation, but was of the opinion that this is not a fit
case
days simple imprisonment, however, refused
to extend the benefit of the Probation of Offenders Act, 1958 .
5. PW-1, Arpana Devi, who is the informant ... whether the accused petitioners
ought to have been dealt as per the Probation of Offenders
Act 1958, considering the gravity of offence and the

accused Karam Singh and Khazan Singh were convicted and
