first dying declaration (Ext.PW49/A) and
therefore, the second and third dying declarations are
tutored; (ii) the three dying declarations cannot be
relied ... three
dying declarations are true, voluntary and consistent.
Insofar as third dying declaration, this Court, in paras
(408) to (412) held that the dying declaration
Court.
Elaborating the facts first as they appear from the record, the
prosecutrix was 14 years old. She got a FIR lodged in February ... reported the same night on 21.02.2015. Few months later the prosecutrix
died an unnatural death in her own house. An FIR was lodged
upto 16 yeas old or
above that.
44. In the dying declaration dated 31.03.2006, prosecutrix has
given her age as 18-19 years ... about 1½ years before the date of the recording of
dying declaration of the prosecutrix, her age on the date of alleged rape

the applicant, has supported the say of the prosecutrix and has described
the entire incident which had taken place in the year ... would not fatal to the case of the prosecutrix. He would submit

14. In view of the above, since the medical evidence ... about 13 years, son of
the deceased, have stated that the deceased died after
consuming poison.
