re-evaluate the examination papers of
the petitioner. It is not in dispute that there is no provision
for re-evaluation of any answer scripts ... marks,
which after re-evaluation was corrected to 33.5 marks. As
aforesaid, there is no provision for re-evaluation of answer
sheets at the instance
answer scripts securing 70 marks and above
had been re-examined. Upon such re-examination and depending upon
the methodology in answering the questions, spelling ... more
than 70 marks had been taken for re-evaluation and why not other
answer scripts. As regards the plea of the petitioners that services
re-evaluation
of answer book(s) will be taken into account to the extent
that if the increase of marks due to re-evaluation ... answer
book(s) will be sent to the second re-evaluator. Average of
the two higher awards given by the re-evaluators/examiner
will
supply of answer scripts has been substantially redressed
by the University. However, since the petitioner is not
satisfied with the evaluation of the theory papers ... supplementary papers re-evaluated by a senior examiner
of the University who did not have the occasion earlier to
evaluate such answer scripts
circumstances of the case justified. The review in the
form of re-evaluation, at least in this instance, has operated rather
harshly. It is nobody ... answer
key or the specious result contributed to them. Had the
contrary been the case, it would have justified their ouster
upon re-evaluation
Applicant has given the answer as 3330/- which is a stage higher than 3300/-. However, after re-evaluation the examiner has given only 5 marks ... examiner as zero in the first instance and 5 on re-evaluation is extracted below:-
